SUPPLIER: Pendragon Photography trades under David Butcher Photography, owned by David Butcher

COSTS: My event photography rate is £195 per hour, with a minimum booking time of 2 hours. The time charged will be determined by the time of day saved by the camera for the first until the last digital images captured. The cost will also be capped at a maximum of £1495 for up to 12 hours on site. This charge includes my travel time & expenses for first 50 miles from SO21 1SB (Colden Common, Hampshire) and back (additional mileage above that will be charged at 60p per mile, plus any other expenses incurred (hotel, trains, flights, etc.) at cost against receipts. All images taken during the event will be retouched (optimisation of colour balance, contrast, brightness and cropping), and the resultant images will be uploaded into your dedicated gallery on my web site within 7 days of the event finishing, where a low resolution version with my watermark logo may be previewed. As soon as payment in full has been received (either as a cheque, in cash or bank transfer), these images (in highest resolution, slightly-compressed, ca. 6000 x 4000 pixels jpg format without my watermark logo) will be supplied on a DVD.

BOOKING DEPOSIT: A deposit of £150.00 is required at the time of booking, together with a signed contract, if you wish to reserve the date. Dates will only be reserved when this deposit is paid. Any payments made by credit card incur a charge of 2%. An unconditional refund policy exists for a period of 14 days from receipt of this contract and payment.

BALANCE PAYMENT: A balance payment is to be made not later than 10 days after the invoice has been sent out (after the retouching of the images has been completed, about 1 week after the wedding ceremony). The retouched images will only be supplied to the couple after full payment due has been received, either in cash or my bank account. Payment for albums, prints & frames (if applicable) is to be made in full at the time of ordering.

CREATIVE LICENCE: David Butcher shall be granted creative and artistic licence in relation to the choice of locations and poses used. His judgement on photographic style and the number of photographs taken shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects, Pendragon Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

COPYRIGHT: The 1998 Copyright, Designs, and Patents Act assigns copyright of all photographs taken to David Butcher. The client is hereby granted a royalty-free licence to reproduce any or all of the photographs for their own private use. David Butcher retains the unrestricted rights to use any or all of the photographs for his own advertising purposes (including, but not limited to, Facebook or web site portfolio).

EXCLUSIVITY: David Butcher shall be the sole professional (still) photographer at the venues specified. We do however positively encourage family, friends, and other guests to take photographs throughout the day, but accept no responsibility for any missed shots if they obstruct the view.

ALBUM VIEWING: A mutually convenient appointment for viewing of photographs will be made upon return from honeymoon. The images will be projected, and you will be required to make your album selection at that time

FORCE MAJEURE: No responsibility can be accepted by Pendragon Photography for adverse weather conditions (snow, ice, flooding, gale force winds, etc.), death, injury, sickness or failure of any  photographic equipment. If Pendragon Photography has to cancel this contract for such reasons beyond their control, their liability shall be limited to a full refund of all monies paid. The clients statutory rights are not affected. Pendragon Photography has full Public Liability and Professional Indemnity Insurance.

CANCELLATION: After a period of 14 days from the date of signing the contract, as compensation for loss of income for Pendragon Photography, the following charges apply as a percentage of the booking deposit paid. (Number of days before the wedding) 60 days or less – 100% 61-90 days – 75%. 91-120 days – 50%.

Should the cancelled wedding turn out to be a postponement (including because of Covid restrictions), then, subject to availability, all money paid may be applied to the new wedding. In this case, the total fees chargeable shall be the fee which applies at that time.

In the event of Pendragon Photography having taken another wedding booking on your cancelled or postponed date, a full unconditional refund of your booking deposit shall be made.

COMPLAINTS PROCEDURE: Please address any complaints to Pendragon Photography, either by e-mail or post (details as below). We will endeavour to respond to any complaint within 48 hours.

PRIVACY: Pendragon Photography will store the clients names and wedding details on a private internal database. These details will not be made available to companies or individuals outside of Pendragon Photography.

VALIDITY: This contract is governed by the laws of England at the time of signing and is subject to the jurisdiction of the English courts.
